Generalities

These Terms and Conditions are the standards and rules of use of the website http://www.datosgroup.com (hereinafter referred to as the "Site") and comprehend all the aspects related thereto, the services therein offered or that may be eventually incorporated in the future, and which shall regulate the relation with users and any all individual entering the Site (hereinafter generically referred to as the "User").

The use made by the User of the services included in the Site shall only be regarded as legal and authorized within the scope herein set forth and pursuant to the legal rules in force on the applicable subject.

Acceptance

The registry of the User to the Site, or the access and use of the services and/or contents of the Site shall mean the full acceptance of these Terms and Conditions, so that any User who does not accept the Terms and Conditions or fails to comply with the dispositions herein set forth shall refrain from entering the Site and/or use the services or contents thereof.

These Terms and Conditions may be modified at any time and without previous notice; therefore the User is hereby recommended to check them regularly, since amendments hereto shall be in force and operative as from their publication on the Site.

Registry of Users

The information required for the registry shall be reliable and true, or, otherwise, the Site shall regard the User as not complying with these Terms and Conditions, and shall hold the User liable for any and all damages that falseness or inaccuracy of data may affect either the Site or third parties.

If the links to other pages or websites are included in the Site, the User acknowledges that the Site has no control whatsoever over the linked sites and understands that the link is only and exclusively limited to the placement of the address of the linked site, and does not comprehend under any concept its content or the relation between its owners or developers.

Use of the Services and Contents of the Site

The User accepts to use the services and access the Site contents pursuant to the Terms and Conditions herein set forth, the legal system to which they are subject to, the behavior practices that accepted customs establish and the respect for third parties’ rights.

Prohibitions

Any and all use of the services or contents that aims to be or is harmful to third parties' rights, infringes the legal system in any way whatsoever and/or constitutes an offensive practice shall be regarded as forbidden use by the Site due to infringement of the object of said Site. The following actions shall be regarded as forbidden: use of the services or contents, or incorporation of contents to the Site that may result offensive, discriminatory, crude, inappropriate; those that promote or constitute illegal, criminal or blameworthy actions; those with advertising or business purposes not expressly allowed by the Site, and/or those which have the objective of gathering information of third parties or Users and/or infringe security, integrity and/or the normal functioning of the Site.

Likewise, the User hereby declares to be the owner of or be duly authorized by the owners of intellectual property rights that may be related to the contents they incorporate to the Site, thereby refraining from incorporating any kind of content which violates the foregoing. The User agrees to be liable to the Site and third parties for damages that may arise from such breach.

The Site is exclusive property of their owners, whenever it is not licensed or given to third parties, including, but not limited to, images, design, compilations, codes, sounds, brands, titles, designations, mentions, distinctive signs, logos, and all composing material. The ownership of the total contents incorporated by the User to the Site shall be property of its owners as intellectual property in the category of classification and compilation work. This one is made up of the selection of the total contents that is part of it. The User irrevocably assigns and transfers to the owner of the Site all the rights that may belong to him or her on the selection of the content made to be incorporated to the Site. The Site or its owner, as appropriate, withhold any and all rights on the material and do not assign or transfer in favor of the User any right on their intellectual property or that of third parties. Any reproduction, distribution and/or modification of the Site shall be expressly authorized.

Waiver

Delay or omission of the Site in demanding the strict compliance with these Terms and Conditions or the search for its offenders shall not be construed as waiver of any right.

Nullity

If any disposition provided within these Terms and Conditions is declared null or void, such nullity or invalidity shall only affect such disposition; the rest shall remain in force.

Jurisdiction Governing Law

The law applicable to this contract will be that of the Law of the State of Florida in the USA. Any controversy that arises in relation to this contract will be resolved through legal arbitration, in accordance with the laws of Florida in the USA, at the seat determined by the Arbitral Tribunal, in Spanish or English, in accordance with the Rules of the Center Business Conciliation and Arbitration (CEDCA), by one (1) sole Arbitrator appointed in accordance with that Regulation.
